1. Agreement and Acceptance

These Terms form a legally binding agreement between you and Marc Enke, operating as StudyMaxx.

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. Description of Service

StudyMaxx is an AI-powered study platform designed to support learning. Features may include:

  • AI-generated flashcards from notes, documents, images, and links
  • Study modes such as quizzes, matching, and repetition
  • AI-assisted explanations and math support (MathMaxx)
  • Study planning and progress tracking
  • Cross-device synchronization and account-based storage

We may modify or improve the Service at any time.

3. Account Registration

To access certain features, you must create an account by providing a valid email address or using a third-party login provider (e.g. Google).

You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activity under your account

You must notify us immediately of any unauthorized access.

4. User Responsibilities

You agree to:

  • use the Service only for lawful purposes
  • not upload or share content that violates intellectual property or other rights
  • not misuse, interfere with, or attempt to compromise the Service
  • not share, sell, or transfer access to your account
  • comply with all applicable laws

5. Content and License

You retain ownership of the content you upload.

By using the Service, you grant StudyMaxx a limited, non-exclusive, worldwide license to process, store, and display your content solely for the purpose of operating and improving the Service.

6. AI-Generated Content

StudyMaxx uses AI to generate study materials and assistance.

  • AI-generated content may be inaccurate or incomplete
  • You are responsible for verifying outputs before relying on them
  • The Service is intended as a study aid, not as an official or authoritative source

7. Subscriptions and Billing

Certain features require a paid subscription.

  • Subscriptions renew automatically unless cancelled before the end of the current billing period
  • You may cancel at any time; access continues until the end of the billing period
  • Payments are processed via third-party providers (e.g. Stripe)
  • Refunds are provided only where required by applicable law or the payment provider's terms

8. Free and Paid Features

We may offer both free and paid features. The scope and availability of features may change over time.

9. Limitation of Liability

To the extent permitted by applicable law, StudyMaxx shall not be liable for indirect, incidental, or consequential damages, including loss of data, loss of study progress, or academic outcomes.

Nothing in these Terms excludes or limits liability where such limitation is not permitted by law, including liability for intent, gross negligence, or breach of essential contractual obligations.

The Service is provided "as is" without warranties of any kind.

10. Academic Integrity

You are responsible for ensuring that your use of the Service complies with your institution's academic integrity rules.

StudyMaxx must not be used for cheating or violating examination policies.

11. Suspension and Termination

We may suspend or terminate your access to the Service where justified, including in cases of violation of these Terms or misuse.

Inactive accounts may be deleted after a prolonged period of inactivity, with prior notice where required.

Upon termination, your right to use the Service ceases. You may request access to or deletion of your data in accordance with applicable law.

12. Third-Party Services

The Service relies on third-party providers to operate, including:

  • AI providers (e.g. Google Gemini, OpenAI, Deepgram)
  • Payment providers (e.g. Stripe)
  • Infrastructure and database services (e.g. Supabase)
  • Authentication providers (e.g. Google OAuth)
  • Hosting and analytics providers (e.g. Vercel)

Your use of the Service may involve interactions with these providers.

13. Changes to the Terms

We may update these Terms from time to time.

If changes are material, we will provide appropriate notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws applicable at the place of establishment of the operator, without prejudice to mandatory consumer protection laws in your country of residence.

If you are a consumer, you may have additional rights under your local laws which cannot be limited by these Terms.
